Establishing Paternity for Children Born to Unmarried Parents
 There are many things for a pregnant woman to think about when she is getting ready for the birth of her child. And with the increase in single parenting, there is one question that often goes unanswered: Paternity. If a pregnant woman is unmarried, then she will have to decide whose name to put on her child’s birth certificate.
Though the law varies from state to state, some states follow the common-law Mansfield’s Rule. According to this Rule, if a woman is married at the time she gives birth, or if she has been married during the last 300 days, then her husband (or ex-husband) is assumed to be the father. But what about women who aren’t married? What if they question who the father might be? If they aren’t sure about the paternity of their child, then they need to have a DNA paternity test. Without a paternity test, they could name the wrong father on the birth certificate, potentially creating many complicated legal problems.
